Martha Stewart Still Stewing Over Donald Trump

SATURDAY JANUARY 12, 2008 06:40 PM EST

Talk about slow cooking – Martha Stewart is still mad at Donald Trump.

The two moguls first clashed in late 2005, when Stewart's Apprentice spin-off debuted shortly after Trump's show, starting a war of words.

More than two years later, Stewart's still stewing.

"Donald said some things in all the hastiness that were unforgivable and I don't have time for people like that," she said at the New York Times Art & Leisure Week Forum on Friday.

Stewart, however, has found time – for a long time – with her billionaire boyfriend, software tycoon Charles Simonyi. She says they've been together for 14 years.

"We've kept it quiet," Stewart says.

Stewart is 66, her boyfriend 59, an age difference that played a role in their courtship.

"Our first date started with a bet," Stewart says. "He bet that he was older than me. I won of course. ... We bet for a substantial amount of money. Then after that we started hanging out."

Nicole Richie, Joel Madden Have a Girl

FRIDAY JANUARY 11, 2008 08:20 PM EST

Nicole Richie and her rocker boyfriend Joel Madden are the parents of a daughter, the couple's rep at Handprint Entertainment tells PEOPLE.

Harlow Winter Kate Madden was born Friday at Cedars-Sinai Medical Center and weighed 6 lbs. 7 oz.

"The beautiful healthy baby girl left the hospital with her ecstatic parents," says the rep, who confirmed the birth to PEOPLE exclusively.

Richie, 26, said she was pregnant in July, telling Diane Sawyer on Good Morning America: "I would really want to be someone my child would look up to."

Later, Richie, who had a famously wild childhood, said the idea of parenthood had made her more mature. "When I found out that I was pregnant, there was just something inside of me that felt a responsibility to mend any issues that I've had with my parents in the past, because, listen, I've put them through a lot," she said.

As for Good Charlotte frontman Madden, 28, he told PEOPLE in November he was looking forward to being a dad. "Having a baby is the most exciting thing that's ever happened to me, and to us," he said.

And the new parents plan to teach their little one the value of generosity. In December, the couple started the Richie Madden Children's Foundation to help the less fortunate. "We want our child to be a part of the community, and to know that there's a responsibility to help the community," Madden said at the time.

The couple have yet to set a wedding date, but in September Madden said "marriage is in our future" – he just wasn't sure when. "Right now our priority is our family and is the baby," he said. "That's all we've been thinking about. We are in love and are really happy."

Courtney Thorne-Smith Has a Boy

FRIDAY JANUARY 11, 2008 07:00 PM EST

Courtney Thorne-Smith and husband Roger Fishman welcomed a son, Jacob Emerson Fishman, on Friday, the actress's rep tells PEOPLE.

This is the first child for the According to Jim star and Fishman, who owns a media company.

"Mother and dad are thrilled," the rep says. "They say the baby is absolutely gorgeous."

Thorne-Smith, 40, and Fishman, 47, were married on New Year's Day 2007.

Comedian David Alan Grier Welcomes a Girl

FRIDAY JANUARY 11, 2008 07:50 PM EST

Actor-comedian David Alan Grier and wife Christine Y. Kim had a baby girl, the couple tell PEOPLE.

Luisa Danbi Grier-Kim – Danbi means "sweet rain" in Korean – was 7 lbs., 6 oz and 20 inches long. She was born at 1:04 p.m. Thursday by planned C-section.

"She's amazing. Her looks evolve every moment, and she looks like me and David," Kim told PEOPLE after delivering the couple's first child, surrounded by family members in the delivery room. "I'm feeling euphoric, and David is ecstatic. He's the perfect proud father."

Grier, 51, and Kim, associate curator of the Studio Museum in Harlem, were married in July and had been splitting their time between New York and Los Angeles.

Kim said last October she was having a smooth pregnancy.

"We're really excited. I have no morning sickness, no bizarre cravings" she said. "As far as David is telling me, unless he's lying, I haven't had any crazy, hormonal mood swings. It's been a pleasant pregnancy so far."

Police, Firefighters to Testify at Britney Hearing

FRIDAY JANUARY 11, 2008 04:45 PM EST

Police officers, firefighters and paramedics who responded to Britney Spears's home last week will testify at her custody hearing on Monday, a source tells PEOPLE.

"The emergency personnel will describe what transpired that night," the source says.

Court documents show Kevin Federline's attorney Mark Vincent Kaplan on Thursday subpoenaed the LAPD investigative report and the identity of the officers on the scene at Spears's four-hour custody standoff.

If the court decides on Monday to further suspend Spears's visitation rights, the singer may not see her sons until April, when the ex-couple's custody trial begins, Kaplan told PEOPLE.

As for whether Kaplan is amenable to Britney regaining visitation, he told PEOPLE on Monday, "It's a very short time since the events of Thursday and certainly I have seen nothing that has caused me to believe that there are dynamics in play now that will change my mind about the orders we sought."

Federline was temporarily granted sole legal and physical custody of sons, Preston, 2, and Jayden, 1, after Spears was hospitalized. Spears and Federline are not required to personally show in court on Monday.

'Medically Treatable Reason'?

"At the next hearing, it's extremely unlikely Spears will get visitation restored to what she had," says family law attorney Lynn Soodik, who's not involved in the case. "One argument she could present is that the standoff was due to a medically treatable reason, and that she's now treating that problem."

"On the other hand, it's a terrible thing to keep children away from their mother," Soodik adds. "The courts will have to weigh that against the trauma of another possible standoff situation."

Even if Spears receives no custody after April's trial, "custody arrangements are always modifiable," Soodik says. "Since the kids are so young, that would just be the end of Round 1."

At the trial in April, a child custody evaluator will recommend to the court who the kids should be with, and any additional evidence regarding Federline's original request for primary physical custody.

"Until the kids turn 18, we can expect in years to come that both parties will be back in court," Soodik says.

Fergie & Josh: Wedding Plans in 'Preliminary Stages'

FRIDAY JANUARY 11, 2008 02:15 PM EST

Josh Duhamel has his life in order – he has a hit TV show, stunning good looks and new fiancée. The only complication? Planning a perfectly fergalicious wedding.

Recently engaged to Fergie, his girlfriend-of-three-years, the TV star told PEOPLE, "We're in the preliminary stages" of wedding preparations. (As for a potential date, the actor would only say "soon.")

His fiancée, a.k.a. The Dutchess, did not join Duhamel at Thursday's 100th episode celebration for Las Vegas at the Palms Casino Resort – but their pending nuptials were clearly at the forefront of his mind. And Vegas, being the wedding capital of the world, wasn't giving him any ideas, either.

"Right now, we're just figuring it all out," he said, adding that they haven't settled on a size or location for the ceremony. "We're just enjoying it. It's all great, though."

News of the couple's engagement first broke on Christmas Day. "I feel like the luckiest girl in the world," Fergie, 32, told PEOPLE soon afterward. "I'm thrilled."

Also thrilled: Duhamel, whose NBC show is still going strong in it's fifth season. Joined castmates Molly Sims, Camille Guaty and James Lesure, the actor accepted the key to the city before dining at N9NE Steakhouse and retreating to a private cast party.

"We all feel very fortunate, lucky and excited to be here," he said.

Reese Witherspoon: 'Not Enough Hours in Day' with Kids

FRIDAY JANUARY 11, 2008 06:50 PM EST

How does Reese Witherspoon stay grounded? By having children who've barfed on her shoes before award shows.

Nevertheless, the Walk the Line Oscar winner – and now-single mother of 8-year-old Ava, and 4-year-old Deacon – says she's glad she's got time at home with them.

"Like every working parent, I sometimes feel that there are not enough hours in the day," Witherspoon, 31, tells Marie Claire for its February issue. "But overall, I'm very fortunate that my job has a lot of flexibility. I spend a lot of time with the kids, just around the house. They're still pretty young, so I feel like what I can mostly do is listen to them and be there for them."

As a mom, she says, "I worry about my kids growing up and how the world might hurt them. But at the same time, I absolutely do not worry about them growing up – because they have great values and a great sense of self."

The New Orleans native learned her parenting skills from her own mother and father, who were both doctors.

"I had parents who believed I could do anything – and I know how that made me feel," says the actress "I think both my parents, having careers in the medical profession, feel they are helping people on a daily basis, and that was inculcated in me as a value. I had to struggle with giving up the idea of becoming a doctor myself."

As for fun around the house – besides messing up mommy's shoes – Witherspoon says her family’s guilty pleasures are "game shows like the new Crosswords and Deal or No Deal. And Are You Smarter Than a 5th Grader? is very popular in my house."

O.J. Simpson Going Back to Jail

FRIDAY JANUARY 11, 2008 04:20 PM EST

O.J. Simpson is heading back to jail tonight, PEOPLE has learned, after court officials confirmed that his bail was revoked.

Simpson will spend the weekend behind bars in Las Vegas as he awaits a court hearing on the matter on Wednesday.

Documents allege that the fallen football star violated his court-approved bail agreement in an alleged armed robbery incident by trying to contact a co-defendant in his case.

"[Simpson] attempted to dissuade a [Clarence Stewart] from testifying and cooperating with law enforcement," court documents said.

Simpson, who was behind bars on 11 felonies, bailed out after agreeing to turn over his passport and have no contact with any involved in the case. The documents claim that Simpson tried contacting Stewart via his bail bondsman on Nov. 16 last year.

A rep for the You Ring We Spring Bail Bonds said, "We have nothing to say at this time."

In a profanity-laced message, Simpson stated that he hoped Stewart was telling him "the truth."

A spokesman for the Clark County District Attorney did not return calls.

Meanwhile, Kim Goldman, the sister of victim Ron Goldman who was killed in 1994 with Nicole Brown Simpson, says she and her father Fred were "elated" by the news that Simpson is in trouble again.

"He thinks he's above the law – that he doesn't have to honor the rules," Goldman told PEOPLE. "His egotistical behavior gets in the way and it gets him in trouble and I love it. He is sending the message that he doesn't show respect for the law."

Katherine Heigl: I Have My Diva Moments

FRIDAY JANUARY 11, 2008 03:45 PM EST

Katherine Heigl can cross another milestone off her list.

In addition to tying the knot with rocker Josh Kelley last month and scoring box office gold in the summer hit Knocked Up, the Grey's Anatomy star, 29, has just been named Cosmopolitan magazine's Fun Fearless Female of the Year – even though the year's only two weeks old.

Whether that's how the new bride sees herself, however, she tells Cosmo for its February issue, "I pride myself on being kind, but that's not to say there aren't moments when I'm a diva. Everybody has bad moments."

Fortunately, she says, "There are people in my life who keep me grounded, so I couldn't behave that badly, even if I wanted to."

As for who some of those people might be, she says of Kelley, "Josh came into my life and I realized, Oh my God, you're someone I can really trust and go to when things are hard. To have that in a partner is huge"

Britney Takes a Mexican Vacation with Photographer

THURSDAY JANUARY 10, 2008 07:30 PM EST UPDATED

Britney Spears spent a brief Mexican holiday with her paparazzi friend, checking into a hotel in Rosarito Beach and buying a knockoff Gucci purse, according to a local press report.

Spears, 26, wore her pink wig as she and photographer Adnan Ghalib, 35, arrived in a black SUV at the Rosarito Beach Hotel, just south of the Border, at about 3 p.m. Wednesday, according to the Ensenada, Mex., newspaper, Frontera.

Ghalib's own photo agency, Finalpixx, has been photographing the pair's Mexican activities – one picture shows Ghalib hand-feeding whipped cream from a Starbucks cup to the pink-wigged Spears – and posting online updates.

"Britney Spears and Adnan Ghalib are happily dating," the agency says in a post. (The agency notes that Ghalib "is married but has been separated from his wife for over a year.")

The pair have been together for much of the last week.

"After being released from the hospital Britney and Adnan spent the night and the following days together resting, eating, sleeping, shopping and talking about life and the love they have for their families," Finalpixx says, adding that Ghalib, himself, has not spoken publicly because it would "not be of benefit to her for him to do so."

"Should he choose to speak about Britney," Finalpixx continues, "he only has positive things to say about her and the time that they have spent together."

As for the other paparazzi chasing after them, "Despite such heavy scrutiny, the pair are enjoying a healthy, normal relationship," Finalpixx says.

Shopping Trip with Paparazzo

While at the Rosarito Beach Hotel, Spears stopped in a gift shop and purchased an imitation Gucci bag and another bag while Ghalib bought a rosary, spending a total of $60, Frontera reports.

"She looked serious and haggard," a sales clerk told the paper in Spanish. "She didn't have makeup on."

The pop star has been in continuous motion since she lost child-visitation rights and was released from the hospital from a mental-health hold after a police standoff.

Spears went to Palm Desert with Ghalib and cruised around at night in her car, only to get a flat tire and have the car impounded.

Rosie Sends Baby Gifts to Elisabeth Hasselbeck

THURSDAY JANUARY 10, 2008 11:00 PM EST

"Peace prevails" with Elisabeth Hasselbeck and Rosie O'Donnell, as O'Donnell confirmed to PEOPLE Thursday night that she has made up with her former foe – and even bought her a baby gift.

On her way into the premiere of The Little Mermaid on Broadway, O'Donnell said of Hasselbeck's 2-month-old son Taylor Thomas: "He's very, very cute. I saw him on TV, and I sent him a lovely gift, and [she and Hasselbeck] have been e-mailing each other. And peace prevails."

Hasselbeck returned to The View this week, bringing the baby with her.

As for Rosie's baby gifts, they were in proportion to the scale of the conflict between Hasselbeck and O'Donnell when both sparred on The View.

"I sent something for him and something for his big sister [Grace, 2]," said O'Donnell. "Because, as the mother of four, I know that when the newborn arrives, the most important thing is a sibling gift. For [Taylor], it was a lot of clothes, because babies spit up a lot. I go to Baby Gap. There is a standard newborn gift pack – as much as you can buy at the Gap without being arrested. And a learning gift, a soft shape sorter. And then for [Grace] who is older, I got a tea set that she loves."

O'Donnell says that Hasselbeck herself has bounced back after giving birth – and they've stayed in touch. "We e-mail back and forth," she said. "She seems good. She looks like she adopted, like she didn't give birth. She looks perfectly fit and gorgeous already."

Donda West Died of Heart Disease after Surgery

THURSDAY JANUARY 10, 2008 05:35 PM EST UPDATED

Donda West, the mother of rapper Kanye West, died of heart disease while suffering "multiple post-operative factors" after plastic surgery, the L.A. coroner said Thursday.

But an autopsy failed to determine the exact role these factors played in her death following liposuction and breast-reduction surgery, officials said.

West, 58, died on Nov. 10 at Centinela Freeman hospital after friends and family made a frantic 911 call for help from her home in Playa Del Ray.

"The final manner of death could not be determined," the coroner said in a statement. "Multiple post-operative factors could have played a role in the death. The exact contribution of each factor could not be determined. There was no evidence of a surgical or anesthetic misadventure."

Just a day before her death, West had undergone cosmetic surgery with Dr. Jan Adams, who has faced tremendous scrutiny since West died. At the time her death, a family spokesperson said West had passed away "as the result of complications from a cosmetic surgical procedure."

She Opted to Recover at Home

According to the autopsy report, West was able to walk out of the clinic after 5 1/2 hours of surgery, heavily bandaged, and prescribed Vicodin for pain.

"She opted to return to her home for care even though she was advised that she receive post-operative care at another facility," the report says.

At home, she received the care of an "experienced nurse" and two caregivers, though there was no documentation of her temperature readings or other records of her recovery. That night, she took Vicodin for pain, slept and felt better in the morning.

As the day went on, she experienced a sore throat, pain and tightening in her chest, before collapsing in the early evening. A friend at the house called 911 and West was taken to the hospital, where she was pronounced dead in the emergency room.

"What came out of the autopsy released today was exactly what I thought was going to be reported," Adams told Extra. "Out of respect for Kanye West's family, I want to honor the doctor patient confidentiality agreement."

West had been on the faculty of the English Department of Chicago State University for over two decades before retiring from academia to manage her son's career. She recently published Raising Kanye: Life Lessons from the Mother of a Hip-Hop Star. Her only son, in turn, dedicated his song "Hey Mama" to her.

Celebrity Fit Love: Kimberley Locke Dating Her Trainer

January 10, 2008

Kimberley Locke is dating someone new — just don’t call him her boyfriend.

“He’s not officially my boyfriend,” Locke says of Celebrity Fit Club’s notoriously tough trainer Harvey E. Walden IV, who is currently in the midst of a divorce. “[His divorce] is why we’re not a couple yet. That is my rule. Whether you’re separated or married — whatever — I would like it to be cleared up. Until then we can hang out together and have fun together.”

For Locke, romance developed after the Fit Club cameras stopped rolling. “We worked out on the show together for four months and never even said anything to each other,” says the “Band of Gold” singer, 30. “I thought he was mean. I didn’t want him to be mean to me, but then after the show was over and I saw him outside of work, he was really nice.”

Except in the gym. “We do work out together sometimes. We go running and everything, but the whole working out in the gym thing didn’t go so well,” says the American Idol alum, who lost 40 lbs. last year during her stint on Fit Club and later, as a Jenny Craig spokeswoman. “Two bossy people? He wants me to do things his way. I want to do it my way — I’m going to do it my way. It didn’t work out.”

Vogue.com first reported Beckett's arrival.

Rachel Bilson Says No to Nudity

THURSDAY JANUARY 10, 2008 04:00 PM EST

Rachel Bilson almost didn't appear in The Last Kiss because she won't do nudity, the actress reveals in Playboy.

"Movies can be sexy or sexual without showing things," the former O.C. star, 26, said in the issue out Friday. "It's almost a deal breaker. The movie was rated R, and they like to put in nudity wherever they can, but I'm pretty strong willed and believe it can be avoided."

The other thing Bilson won't do is talk about her relationship with Hayden Christensen, even though the two have been spotted together around Los Angeles for almost a year. She will, however, defend his acting chops. "He's an amazing guy and a fantastic actor," she told Playboy. "In those Star Wars movies I thought other people – people who are successful and Oscar-nominated – came off looking much worse than he did. But he caught a lot of s---, which really made me mad."

Other interesting Bilson bits:

• She's scared of mushrooms: "Even the smell makes me sick."

• On waiting her turn in the spotlight: "The roles I want usually go to Kirsten Dunst, Keira Knightley, Scarlett Johansson, Natalie Portman or Kate Bosworth – even though I look younger or older than a few of them. I understand they were once where I am now, and my ultimate goal is to get to that point. Hopefully, I'll achieve it, but you never know."

• On being a celebrity: "It blows my mind that celebrity is such a sham now. ... I'm in this business because of the career I want, not because of the celebrity I want."

Tyra Banks: Where Is the Love?

THURSDAY JANUARY 10, 2008 02:45 PM EST

Her career's on a roll, but some of Tyra Banks's early ambitions have been shoved aside – such as having a baby.

"After the talk show started, and I had Top Model at the same time, it engulfed me so much that it dulled my maternal instinct," the star of both The Tyra Banks Show and America's Next Top Model Banks, 34, tells Essence magazine for its February issue.

Not that the first African-American woman to grace the covers of GQ, Sports Illustrated's swimsuit issue and the Victoria's Secret catalogue has completely abandoned hope of raising a family. "I hope that when I get more of a handle on my life it comes back," she says of the maternal instinct.

Although Banks, who is developing shows for Warner Bros. and one with Ashton Kutcher, is not complaining, she does say, "I'd go to work and women would be crying in my arms on the talk show. But then I'd go home and put my key in my door and ... nothing: no friends, no husband, no children. I feel so full when I'm at work but so empty when I come home."

Though Banks won't open up about it, Essence reports the buzz that she's involved with investment banker John Utendahl, 50 – and that's why she moved production of her shows to New York from Los Angeles.

Responds Banks huffily: "I'm very insulted by that rumor. I employ a lot of people; their livelihoods rest on my shows. The move to New York was a decision I made with my manager. It was not about a man."

Jenna Fischer During Writers' Strike: Jumping Rope and Going to the Dentist

THURSDAY JANUARY 10, 2008 02:45 PM EST

Ever wonder what the stars are doing to pass the time during the writers' strike? For The Office's Jenna Fischer, it involves "doing all the things I can't normally do during the week, like go to the dentist," the actress, 33, tells MySpace for the debut of the site's new Celebrity page. (The site, launched Thursday, also features news from PEOPLE.com.) As for Fischer, she also learned that she's still not ready for jump-roping after injuring her back last May. (She's currently undergoing physical therapy.) "It's too soon to jump rope," she says. "My body can't take any type of high-impact activity. I learned this quickly."

Vince Vaughn: I Talk to Jennifer Aniston 'Constantly'

WEDNESDAY JANUARY 09, 2008 05:10 PM EST

Though they've been apart romantically for more than a year, Vince Vaughn is still known as Jennifer Aniston's ex – and that's fine with him.

"I have such a great friendship with Jennifer," the host of Vince Vaughn's Wild West Show, 37, tells this Sunday's edition of Parade magazine. "Really, I still talk to her constantly. I have a real, genuine connection with Jen. And I have a real appreciation of her. That continues to this day."

The two, who starred together in summer 2006's The Break-Up, dated for a year and a half before breaking up in December 2006, yet their relationship has long remained amicable. In February 2007, he attended her 38th birthday party.

"I always try to keep my relationships quiet and my work at the forefront," Vaughn says.

"I haven't been someone to go and talk about those things, because that's not what I want to be known for," he adds. "In regular life, people date, and sometimes it works out, and sometimes it doesn't. We get more attention because we're more known."

Women Like the Big Kid

Vaughn also says his perceived immaturity – like his 2005 Wedding Crashers costar, Owen Wilson, he's known as a big kid – hasn't affected his relationships.

"I've been fortunate that the women I've dated seriously get used to it, because I think I'm attentive and aware in other ways," Vaughn says.

"It hasn't hurt my relationships. It's not a big deal," he says. "With relationships, for me, the biggest foundation always is that you can laugh with each other, that you have fun with each other, because life really is made up of all the little moments. Of course, I also got better at communicating."

Laila Ali Joins The Early Show

WEDNESDAY JANUARY 09, 2008 06:45 PM EST

Laila Ali has a new day job: The American Gladiators co-host is joining CBS's The Early Show as a contributing correspondent starting Jan. 11.

"I'll be doing pieces that are inspiring. I hope people walk away from what they see feeling good," Ali, 30, tells PEOPLE. "It's going to be a lot of fun."

"She's a great addition to the The Early Show team," says senior executive producer Shelley Ross. "She has been a dedicated educator and author in areas of heath and fitness. She has a spiritual side, while being a fearless competitor."

But would she ever compete in Gladiator stadium? "Uh, no," says Ali with a laugh. "Doing a bunch of different challenges and having TV involved, it's not my type of thing. It's more fun commentating and watching them from the sidelines.

Audrina Patridge: ‘I Am Not Ditching Lauren for Heidi’

January 9, 2008

While the Internet has been abuzz that Audrina Patridge is fighting with her Hills costar — and best friend — Lauren Conrad and getting friendly again with (gasp!) Heidi Montag, Patridge has taken to MySpace to clear up what she calls “false rumors.”

“I am not ditching Lauren for Heidi,” she writes in a bulleted post on her MySpace blog, refusing to enter the conflict between the former friends. “It is none of my business with what is going on between them and I stay out of it! . . . . I have enough of my own personal drama.”

Patridge also addresses other rumors stemming from “gossip in trash mags,” including reports that she and Conrad had plastic surgery and no longer live together.

Lindsay Lohan Sued By DUI Chase Passenger

WEDNESDAY JANUARY 09, 2008 03:15 PM EST

The woman being chased by Lindsay Lohan before the star's notorious DUI arrest last July wants her day in court.

According to papers filed in Los Angeles Superior Court in late December and obtained by the Associated Press, Tracie Rice was in a vehicle pursued by Lohan and driven by Michele Peck, the mother of Lohan's recently resigned assistant.

Rice is seeking damages amid claims that because of the pre-dawn incident she has had to shell out $7,000 in medical expenses, including those to a $175-per-visit therapist. She also says she lost her $60,000-per-year job.

In her papers, Rice says that $3,500 has been spent with the therapist in dealing with her residual terror. She also saw a physician, a chiropractor and a pharmacist – and paid roughly $150 for prescriptions. An additional $2,000 was said to be paid in miscellaneous expenses.

Rice states she thought she was being carjacked when an SUV, driven by Lohan, pursued her and Peck at high speed, putting the two of them "at extreme risk of death or injury," until they made it to the Santa Monica police station and were greeted by officers with guns drawn.

Emotional Distress

In August, Rice filed suit against Lohan for emotional distress. The lawsuit seeks unspecified damages and payment of medical and other expenses related to emotional distress.

Lohan's rep had no comment.

Lohan is working on her sobriety, her lawyer has said, but was recently seen slipping. After spending two months in a Utah rehab in 2007, Lohan was videotaped drinking from a champagne bottle on New Year's Eve in Italy.

After a plea deal, Lohan spent a mere 84 minutes in jail last November for both DUI charges.

Simon Cowell: Britney, Call Me Anytime

WEDNESDAY JANUARY 09, 2008 04:10 PM EST

It's a New Year – and Simon Cowell has some new advice for an old favorite of his, Britney Spears.

Speaking to PEOPLE on Wednesday afternoon, the American Idol judge says there is still time for the troubled, 26-year-old pop star to get her life and career back on track.

"It's never too late," says Cowell, 48, who has shown support for Spears in the past. "I think she's the most searched artist on the Internet at the moment, so she has a head start."

As a producer he is also willing to step in and personally lend a hand. "I genuinely think that if I sat down with Britney and, No. 1, remind her of all the good things in her life – which are her kids, her money, her success, everything – I'd try to give her a sense of perspective. And then I'd take her out of where she's living at the moment and ask her to go and live with her family – and live normally – for six months."

His rationale, he said, is "because if you live normally and do normal things, you'll suddenly find that the paparazzi aren't camped outside your front door every day. Most importantly, just give her a sense of perspective, because it looks to me at the moment that she's out of control and she needs to have someone in her life who she's going to listen to."

Adds Cowell, "She's welcome to call me anytime."

John Mayer and Minka Kelly Quietly Split

WEDNESDAY JANUARY 09, 2008 04:25 PM EST

John Mayer and Minka Kelly have quietly called it quits after a brief romance.

The musician, 30, and the 27-year-old Friday Night Lights actress split over a month ago, but are "still friends," sources tell PEOPLE.

Despite their split, the two have remained close: Kelly showed her support for Mayer at his December concert in L.A. and accompanied him to the after-party at Parc where they got cozy in a booth together. The two were also spotted days later having breakfast in L.A. and also drinks at The Sunset Marquis Hotel in West Hollywood.

According to a pal of Kelly's, "Minka told a couple friends that she and John had broken up but she really didn't want to tell anyone."

The couple became involved earlier this fall. They were spotted dining together several times in Austin, Texas, in early October and again later that month in California. They also met up with Chris Ivery and Ellen Pompeo at a Knicks game in New York in November.

The split, however, may not last for long. When Mayer dated Jessica Simpson, the couple broke up and reunited numerous times before finally calling it quits for good.

A rep for Mayer had no comment. Kelly's rep couldn't be reached for comment.

Mischa Barton Family Rep Rips Tabloid Story About Sister

WEDNESDAY JANUARY 09, 2008 08:40 PM EST

A rep for Mischa Barton's family on Wednesday blasted a tabloid report that the actress's sister was hospitalized for a drug overdose.

"Mischa understands that as an actress and a public person she needs to address her issues in a timely and appropriate manner. That being said, she's the only public person in her family and we will not address these sleazy, tabloid reports," rep Howard Bragman tells PEOPLE. "I think these pieces of s--- who work at hospitals and sell private information are not only breaking the law, but they're morally reprehensible. They're selling people's private information for the price of dinner for four at Lawry's. And I hope they choke on their prime rib."

The National Enquirer reports that 19-year-old Hania Barton was hospitalized over the holidays after overdosing on a muscle relaxer.

Regulators: Hospital Put Dennis Quaid's Twins in Jeopardy

WEDNESDAY JANUARY 09, 2008 09:10 PM EST

Cedars-Sinai Medical Center was cited by California regulators for placing Dennis Quaid's newborn twins in immediate jeopardy by giving them 1,000 times the proper dosage of medication, the Los Angeles Times reports.

"This violation involved multiple failures by the facility to adhere to established policies and procedures for safe medication use," the Department of Public Health writes in a 20-page report. "These violations caused, or were likely to cause, serious injury or death to the patients who received the wrong medication."

The hospital overmedicated a total of three children with the blood thinner heparin on Nov. 18. The hospital has said a "preventable error" occurred with the three patients and that a "series of changes" have since been made in training and procedures.

"The Department of Public Health's investigation and report of how the heparin error occurred is a confirmation of our own internal findings about the error, which we previously shared last November," Michael L. Langberg, chief medical officer for Cedars, said in a statement.

State regulators haven't decided whether to fine Cedars-Sinai for the lapses, Kathleen Billingsley, deputy director of the Center for Healthcare Quality, tells the Times, but she notes the hospital cooperated with the investigation.

Britney Spared from Worst-Dressed Lists

TUESDAY JANUARY 08, 2008 02:05 PM EST

Just as Mr. Blackwell spared Britney Spears from his annual and infamous worst-dressed list, PETA has pulled the troubled pop star from their style poll.

Spears was leading PETA's recently launched worst-dressed celebrity poll, but organizers have removed her from the running in light of her hospitalization over the weekend.

"At this point, Britney needs a break – from everybody. Maybe when her head is clear, she'll have a change of heart about wearing fur. If not, we'll be back biting at her heels," PETA Senior Vice President Dan Mathews said in a statement.

Kate Moss is now in the lead as polling continues – "Nothing completes the transition from supermodel to super tramp like a fur coat," said Mathews.

Victoria Beckham, Amy Winehouse and Mary-Kate Olsen rounded out Blackwell's top three offenders, while PETA's list includes fur wearers Lindsay Lohan, Kate Bosworth, Jamie Foxx, Kid Rock, Mary J. Blige, Eva Longoria, the Olsen twins and Vanessa Williams.

Britney Spears's Car Impounded

TUESDAY JANUARY 08, 2008 08:30 AM EST

Britney Spears's wild ride left the troubled pop star car-less Monday night, after cops impounded her abandoned vehicle.

"Ms. Spears's car was impounded," Lt. David Grimes of the Los Angeles Police Department, West L.A. station, said – after a flat tire had caused the troubled pop star to leave her white Mercedes in the middle of the road in Brentwood, Calif.

"Officers on the scene told me it was blocking the roadway," said Grimes, "and that it was unsafe enough to leave at the location."

After she had left the car, Spears – who had ventured away from her Studio City home to go to a drugstore – was given a lift by a paparazzo who had been trailing her.

As for her Mercedes, "It was towed by a private company that's contracted with the city," said Grimes. "Her car is being held at the official police garage tow yard."

The standard pricing at the Quicksilver Towing facility is a $104 towing fee, plus $32 for each day it remains in the tow yard. If the car isn't picked up within 30 days, it gets put up for auction, an employee told PEOPLE.

Regarding the status of the impounded vehicle, spokesman Grimes said, "There's not a hold on the vehicle. She just needs to show up to obtain it. She'll have to pay tow fees, and that total cost depends on how many days she leaves it there."

He added, "But she won't get any citations or fines."

After the photographer dropped off the pop star and her assistant, Carla, at home, the two women jumped into a Toyota Camry and went to the Four Seasons Hotel in Los Angeles.

Johnny Depp, Reese Witherspoon Named Top Stars at People's Choice

Jan. 08, 2008 | 11:15 PM EST

Although the writers' strike continues to slow down the award season, on Tuesday night the people were heard – and not just in New Hampshire.

Yes, the 34th annual People's Choice Awards carried on. Rather than cancel the show, producers retooled it as an understated, "newsmagazine"-style broadcast, hosted by Queen Latifah on CBS. The actress acknowledged the changes immediately, telling viewers, "I know this show's a little different than last time. But we have what's important – you, the people, and all your favorites all night long."

Apart from the host – who spent much of the broadcast directly addressing the cameras and walking around an empty studio – celebrity appearances were relegated to vintage clips (montages mostly of memorable moments) and prerecorded acceptance speeches. Top winners included Johnny Depp and Reese Witherspoon as favorite male and female movie star, respectively, and Justin Timberlake as favorite male singer.

Even in the taped acceptance speeches, the writers' absence was noted often. As Joaquin Phoenix received his favorite leading man trophy, he flipped through cue cards rather than speaking. "I'm speechless without the writers," his cards read. "Seriously. But in my own quiet way, I want to thank the millions of fans that voted for me for favorite leading man."

And Witherspoon, who currently stars Rendition, said, "We are nothing without our writers. But we are also nothing without our audience."

Other major winners included: Ellen DeGeneres, who nabbed two awards – one for favorite talk show host and also for favorite funny female star. Grey's Anatomy favorite Katherine Heigl picked up favorite female TV star. Country group Rascal Flatts also earned two awards, taking home favorite country song for "Stand" and favorite group.

Here is a rundown of some of the night's big winners:

Kate Winslet Taking Over Nicole Kidman's Role

TUESDAY JANUARY 08, 2008 03:50 PM EST

Kate Winslet is stepping in to take over the role vacated by Nicole Kidman in The Reader, PEOPLE has exclusively learned.

Sources confirm that, in fact, Winslet was originally offered the role but couldn't commit due to schedule conflicts. Kidman pulled out of the film after announcing her pregnancy.

"Kate was offered it first before Nicole but couldn't do it but the dates clashed with commitments to Revolutionary Road," says an insider. "So the dates changed, Nicole then got pregnant and now it has come back to Kate."

Based on German author Bernhard Schlink's bestselling 1995 novel – and Oprah's Book Club selection – the film is about an affair between a teenage boy and an older woman in post-WWII Germany.

"Actually everyone is happy now – Nicole as she has a baby on the way, Kate because she has this great role she originally wanted to do, and the filmmakers are too," says the source

Katherine Heigl's Honeymoon Highlight? The Piña Coladas!

TUESDAY JANUARY 08, 2008 11:15 AM EST

Katherine Heigl still had that honeymoon glow as she walked the red carpet Monday night for the L.A. premiere of her romantic comedy 27 Dresses.

So what does the actress – who wed musician Josh Kelley Dec. 23 during a Christmas-themed ceremony in Park City, Utah – remember most from her whirlwind Mexican getaway?

"Ahhh, the Piña Coladas!" she told PEOPLE. "Oh my God, Cabo! The Esperanza [resort] and Piña Coladas – it doesn't get a lot better."

The Grey's Anatomy star, 29, turned serious, though, when asked by a reporter about Britney Spears's recent meltdown.

"I can't possibly imagine what that young girl is going through," she said. "I just hope ... that even with all this attention, people can find it in their hearts to be compassionate and not be so judgmental. She is obviously in a great deal of drama and pain, and that's a horrible thing for someone to go through in front of the entire world – and I'm sorry for her."

Mariah Carey: Gossip Is 'Complete Untruth'

TUESDAY JANUARY 08, 2008 04:05 PM EST

Mariah Carey is fighting back against a new Internet report that suggests she is feuding with Jennifer Lopez.

The report, which has spread in the blogsphere Tuesday, includes a quote – supposedly from Carey – saying that she would rather appear on stage with a certain animal than ever share a stage with Lopez. The story, Carey tells PEOPLE. is "a complete untruth."

Carey insists that the quote did not, and would not, come from her.

"This is just some Internet gossip and it's pathetic that people actually entertain the thought that this could be real," Carey adds. "This is another sad example of two strong women being pit against each other."

Carey has a new album due out in the spring, shortly after Lopez is due to give birth

Heidi Montag’s Maxim Moment: Hot or Not?

January 8, 2008

Heidi Montag strikes a seductive pose on the cover of Maxim’s February issue, but The Hills star tells the lad mag she didn’t grow up glamorous — but rather with “humble beginnings.”

Meanwhile, she accuses former friend Lauren Conrad of growing up in a “spoiled Laguna world” and says, “She’s changed. Some people go more Hollywood than others … I’ve heard from other people that she’s a big diva now.”

Of their so-called reality show on MTV, Montag explains that it’s “22 minutes” that’s “edited for drama … It’s not like The Truman Show. They’re not with us all the time, although I wish they were, because it would be a way crazier show. Let’s see how Lauren would look then!”

But what Montag’s fans really want to know is, what’s going on with her engagement to Spencer Pratt?

“It’s on pause,” she admits. “It was causing us to fight, so we decided not to deal with it. I still have [the ring]. But I guess when we decide to resume the wedding, I’ll need a new ring.”

Montag also reveals the kinkiest thing she ever did for former fiancé. “I tied him up the other night, like, ‘I’m going to tie you up, bad boy!’ But I was laughing so hard. I couldn’t take it seriously.”

Miley Cyrus Takes Nation's Capital By Storm

TUESDAY JANUARY 08, 2008 02:40 PM EST

The reaction from fans to Miley Cyrus was so earsplitting at her Monday night Best of Both Worlds concert at the Verizon Center in the nation's capital, that The Washington Post compared the noise level to the sound of a power saw up close: 111 decibels.

"You guys are loud," the Disney Channel star told the crowd, but "you're not loud enough for a Miley Cyrus concert."

The newspaper also said that not since 'N Sync at R.F.K. Stadium in 2001 has a crowd sounded so, well, expressive. And for Cyrus, they only got noisier.

"You guys are even louder than I thought you could be!" Cyrus finally conceded.

But it wasn't just young fans who couldn't get enough of the Hannah Montana favorite. The Post's Reliable Source column reports that reaction to Cyrus when she showed up at D.C. restaurant Morton's after her concert was even stronger than those that greeted Tom Cruise, Queen Elizabeth or Angelina Jolie when they came to town.

"I've never seen anything like it in D.C.," an experienced partygoer told the paper.

Dining with Cyrus were two girls her age, the paper also reported, and their menu consisted of shrimp, steak and chocolate cake.

Hospital Visits

Yet the best reactions of all were those that greeted Cyrus earlier in the day at Georgetown University Medical Center and Children's Hospital, during visits arranged by the non-profit organization Tracy's Kids.

About 100 parents and their children met with Cyrus, who provided autographs and posed for pictures – and pretty much overwhelmed the grateful patients.

When Cyrus asked if any of them had questions, she was met with silence, says the paper. That is, until someone very young asked, "How old are you?"

"I'm 15," she replied.

Britney's (Latest) Wild Ride

MONDAY JANUARY 07, 2008 10:35 PM EST

First a meltdown, then a blowout.

After finally returning to her Studio City home from her forced hospitalization, Britney Spears ventured out in her car Monday evening, only to end up with a flat tire.

Driving her white Mercedes and accompanied by her assistant, Spears, 26, popped a tire in Brentwood after visiting a drug store.

With the paparazzi on her tail, she continued to drive with the flat a few miles down the road without her lights on, and even passed by a gas station.

The singer's flat caused mayhem for the LA traffic. On her way back to her house, Spears pulled over and was met by police officers who allowed her to abandon her vehicle on the side of the road.

Spears was given a ride away from the scene – not by the police, but by photographers who had been trailing her.

Dr. Phil Delivers a Message to Britney Spears

MONDAY JANUARY 07, 2008 07:45 PM EST

Dr. Phil McGraw is telling Britney Spears that she is not too far gone to turn her life around.

"You can make this okay," the TV therapist, who at the request of her family briefly visited Spears while she was in the hospital, says in a message to the pop star that is posted on ETonline.com. "Your family loves you. You may not always agree with what they say, with what they do but they've loved you when you weren't lovable. Turn to the people that love you and listen. You have two children and you are the one in this world to protect them. There is no sacrifice that [your mother Lynne] won't make for you, and there is no sacrifice that your father won't make. They are the people that want nothing from you, and everything for you."

McGraw, a longtime Spears family friend, had planned to do a show about Britney's condition and "the very serious issues surrounding this case. [But] because the Spears situation is too intense at this time, and out of consideration to the family, I have made the decision not to move forward with the taping at this particular time," he announced Monday.

Still, he advises via Entertainment Tonight, "She needs to be in treatment, she needs to be in in-patient care for a period of time. Is she having a rough time right now? Yes she is. Why? I'm not really going to go into that at this point. But I can tell you this is a good person and I truly believe she'll get back to being a good person."

As for the criticism McGraw has encountered over his stepping into the Britney situation, particularly in the tabloids and on blogs, he hurls the brick right back.

"They are waiting for her next meltdown. These are the people that are stalking her and they want to criticize me for trying to help her, for trying to bring help to her in cooperation with the family that loves her. Get real," he says. "Somebody needs to step up and get this young woman in to some quality care – and I do not apologize one whit, not one second, for trying to make that happen."

'Needs to Be in Treatment'

Expanding upon the statements released earlier, McGraw said of Spears on Monday's The Insider and, later, on Entertainment Tonight, "What I'm hoping is to get her some help."

Of the star's general situation, McGraw, who likened getting into visit Spears at Cedar-Sinai Medical Center to getting into Fort Knox, says, "She needs less publicity, not more ... She doesn't need to be on television. She needs to be in treatment, she needs to be in in-patient care for a time."

Spears, 26, was hospitalized early the morning of Jan. 4 under California's "5150 Hold," in which she was deemed a danger to herself or others and could be held for 72 hours for evaluation. But Spears left the hospital on Saturday, well before the 72 hours. Patients can be released early if doctors determine they no longer require treatment or evaluation.

McGraw said what he witnessed visiting Spears in Cedars-Sinai will remain private.

"People forget about Britney for all the time she was a young, talented, delightful woman," said McGraw. "Is she having a rough time right now? Yes, she is. Why? I'm not really going to go into that at this point."

It's Official: Golden Globe Awards Are Canceled

MONDAY JANUARY 07, 2008 07:40 PM EST

The Golden Globe Awards have become a victim of the writers' strike.

Organizers said Monday they’ve officially abandoned the televised formal ceremony this Sunday and will replace it with a press conference announcement of the winners.

"We are all very disappointed that our traditional awards ceremony will not take place this year and that millions of viewers worldwide will be deprived of seeing many of their favorite stars celebrating 2007's outstanding achievements in motion pictures and television," Hollywood Foreign Press Association president Jorge Camara said. "We take some comfort, however, in knowing that this year's Golden Globe Award recipients will be announced on the date originally scheduled."

The drastic move is in response to the Screen Actors Guild pledge that its members would not cross picket lines by the Writers Guild of America, effectively leaving the show without any stars.

Instead of the lavish ceremony, the HFPA, which sponsors the awards, will now announce the winners at an hour-long press conference broadcast on NBC.

"The 65th Annual Golden Globe Awards NBC telecast and champagne dinner in the Beverly Hilton's International Ballroom is officially canceled," the HFPA said in a statement.

The writing had been on the wall that, despite the best efforts of the network and the Hollywood Foreign Press Association, the ceremony was in jeopardy. On Friday it was reported that the nominated actors would not cross the Writers Guild picket lines to attend the ceremony.

In terms of Globe nominations, Atonement led the list of movies in competition, with seven.

Brad & Angelina, Katie Holmes Step Out for Critics' Choice Awards

Jan. 07, 2008 | 11:20 PM EST

As the Golden Globes became the first awards-show casualty in the Hollywood writers strike, the Critics' Choice Awards fared better Monday – and with no picket lines in sight, that meant an all-star showing, from Brad Pitt and Angelina Jolie to George Clooney and Katie Holmes.

The 13th annual awards, handed out by the Broadcast Film Critics Association, are not covered by Writers Guild contracts, so unlike the Globes (and other upcoming awards shows), the Critics' Choice Awards were not impacted by the writers' strike.

So the A-listers showed up to party and celebrate the night's winners. No Country for Old Men was named best picture, with its oddly coiffed bad guy, Javier Bardem, winning best supporting actor.

Other big winners: Daniel Day-Lewis earned best actor (and a standing ovation) for his performance in There Will Be Blood, Julie Christie was named best actress for Away from Her, Amy Ryan was named best supporting actress for Gone Baby Gone (Ben Affleck's directorial debut), and teen-pregnancy comedy Juno was named best comedy.

Inside the auditorium, it was a laid-back party scene: A goateed Pitt got cozy with Jolie (who was nominated for A Mighty Heart), while Sean Penn, Eddie Vedder and Catherine Keener all mingled at the Into the Wild table (Penn's film led with seven nominations).

The writers' strike was still definitely on the minds of everyone, with winners and presenters sending their support while urging both sides to return to the table.

"When the strike happens, it's not just writers [affected]," Clooney said onstage. "Our hope is that all the players will lock themselves in a room and not come out until they finish. We want this to be done. That's the most important thing."

Comedian Eddie Izzard provided his own chilling example of awards-show writing during the strike.

"Okey dokey from WGA came during teatime, so some speechy talk not so good as other mans," he said. "This was wrote in toilet, so only first draft and a bit la-la."

Clooney also delivered the inaugural Joel Siegel Award (named after the late ABC movie critic) to Ocean's Thirteen costar Don Cheadle for his humanitarian work.

Nicole Kidman Is Pregnant

MONDAY JANUARY 07, 2008 06:40 PM EST

Nicole Kidman and husband Keith Urban are expecting their first child, her rep confirms.

"The couple are thrilled," Catherine Olim says in a statement.

For Kidman, 40, this will be her third child. She and her former husband, Tom Cruise adopted two children during their marriage: Isabella, now 15, and Connor, 12.

As for where Kidman and Urban, 40, who will be a first-time parent, may bring up their impending arrival, the couple, though both from Down Under, purchased a farm near Leipers Fork, Tenn., a half-hour southwest of Nashville, in 2007.

The couple, who have been married 18 months, wed, after a yearlong courtship, on June 25, 2006, in a candlelit ceremony at Sydney, Australia's Cardinal Cerretti Memorial Chapel on St. Patrick's Estate at Manly. Guests at the black-tie event included Russell Crowe, Hugh Jackman, Naomi Watts and Rupert Murdoch.

Before the couple even started dating, Kidman made her desire for more children clear. In April 2005, she told reporters that her biological clock was ticking. "I have got hormones running through my system," she said. "That is why I sit wriggling, saying I want to have a baby."

Jamie Lynn Spears Pictured with GED Book

MONDAY JANUARY 07, 2008 09:00 PM EST

It looks like Jamie Lynn Spears is hitting the books.

The 16-year-old pregnant star was photographed in Hammond, La. on Friday carrying a GED book, used to study for a high school equivalency degree.

Spears, who announced last month that she's expecting a baby, was pictured outside a building that houses both the Tangipahoa Parish School System Adult Education Center, which is a GED preparation site, and the Title I Parent Center, which teaches parents how to help their children learn reading skills.

The star of Nickelodeon's Zoey 101 previously attended the prestigious Parklane Academy in McComb, Miss., which she had been going to off-and-on for years, depending on her filming schedule. (She studied with tutors while in Los Angeles.)

Just before Thanksgiving of 2007, Spears enrolled at the school full time, saying that she had completed her filming, according to a school staffer. But after Thanksgiving, Spears said she was needed back in Los Angeles. The source says that if Spears had tried to stay, she likely would have been expelled for being pregnant. The school had no official comment.

Spears has been keeping a low-profile since she announced she is expecting a child – and hasn't been photographed since her big sister, Britney Spears, suffered a meltdown last week.

However, two weeks before Jamie Lynn revealed her pregnancy, she was seen buying several pregnancy-related items, a source tells PEOPLE.

Jamie Lynn Buys Pregnancy Book and Calendar

Spears picked up a pregnancy calendar, the well-known book What to Expect When You're Expecting and a sonogram frame, according to a clerk at the Brookhaven, Miss., baby boutique Expectations.

"It was just random things – she was in here with one of her girlfriends," says the clerk, who asked not to be named. "It was about two weeks before it hit the news that she was having a baby. She hasn't been back. She's probably laying low."

Elisabeth Hasselbeck: Baby Rocks My World

MONDAY JANUARY 07, 2008 04:40 PM EST

Fresh from introducing her new baby – 2-month-old Taylor Thomas – on Monday's The View, Elisabeth Hasselbeck sat down with PEOPLE backstage at her ABC show.

The TV host, 30, and her footballer husband, Tim Hasselbeck, also have another child, Grace, 2.

So, second child: more or less overwhelming than expected?
When they say it rocks your world? It rocks your world, having a second. What is going on!? When does this stop?! ... This is the first time I've brushed my teeth in two months, it was special for today. And I'm constantly trying to balance out everybody's needs. Was I a little bit of a wife today? Sure. 'Here's a cracker, Tim. I'm your wife.' 'Grace, do you want Goldfish for dinner? Okay, I feel bad, 'cause I’m paying a lot of attention to Taylor, so Goldfish it is!' I feel like I'm constantly trying to be the great equalizer in the home. But I love it! I wouldn't want to be anything else, and wouldn't want anyone else doing it for me.

Do you see a big difference, boy vs. girl?
I don't know if it's because he's a boy, or because it's [my] second child, but I kind of let him sit up a little more on his own. He seems a little more sturdy. I'll go, 'Look at that chest. He's strong!' I'm not super-sterilizing everything like I was with Grace. [When she was born] people would walk in and I’d have them put booties on.

Is Tim happy to have a boy at home?
He loves having a boy. There is a difference. But I feel like Taylor's mine. Grace is his, and Taylor's mine – forever.

Are you feeling back in shape?
I'll get there. I'm a little frustrated because I have a little injury in my back, something's bothering me, and I can't run – and we've had really nice weather the last couple of days, and every time I see someone running I get angry at them because I can't. But I'll get there.

Cookbook Author Accuses Jerry Seinfeld's Wife of Plagiarism

MONDAY JANUARY 07, 2008 08:30 PM EST

Jessica Seinfeld, cookbook author and wife of comedian Jerry Seinfeld, is being sued by the author of another kitchen how-to, accusing her of copyright infringement and defamation.

Missy Chase Lapine, author of The Sneaky Chef: Simple Strategies for Hiding Healthy Foods in Kids' Favorite Meals, filed a complaint in U.S. District Court in New York on Monday alleging Seinfeld plagiarized Lapine's book in writing her cookbook Deceptively Delicious: Simple Secrets to Getting your Kids Eating Good Food, published six months later.

"This action for copyright and trademark infringement and defamation arises from conduct that gives new meaning to the terms 'arrogance' and 'greed,'" says the lawsuit, which lists what it alleges are examples of identical language in the two cookbooks. The suit also alleges Lapine alerted her publisher and Seinfeld's to the similarities between the books before Deceptively Delicious came out in October.

The suit also addresses Jerry Seinfeld's comments about Lapine in his defense of his wife in public appearances. On The Late Show with David Letterman in October, Seinfeld called Lapine a "wacko" who had been "waiting in the woodwork" for a chance to attack the Seinfelds.

"My wife never saw the book, read the book, never used the book," he said.

Promoting Deceptively Delicious on The View in November, Jessica Seinfeld defended her collection of kid-friendly recipes.

"I can understand why she would have been frustrated," she said. "It must have been hard to see how quickly my book took off. I never saw her book, I never saw her recipes, nor, as a person, would I ever do something like I was accused of doing."

Halle Berry: I'm 'Three Times the Girl I Usually Am'

MONDAY JANUARY 07, 2008 02:00 PM EST

Halle Berry says she's found the secret to surviving a glamorous Hollywood event while being seven-months pregnant.

"It is true that I am three times the girl I usually am. I have to say there are some really wonderful things that come along with that," she said Saturday night in accepting an award at the Palm Springs International Film Festival. "This is the first red carpet that I've really walked down where I didn't have to think about holding in my stomach – because I can't."

Berry, 41, expecting her first child with boyfriend Gabriel Aubry, told the black-tie crowd of 1,700 at the festival's awards gala that she also can now finally enjoy a big dinner.

"It's the first time I've been to an awards show where they served a meal and I actually ate it – the whole thing," she said. "I was eating off everybody else's plate and that felt very liberating and good."

Berry, who most recently appeared in Things We Lost in the Fire, was presented with the Desert Palm Achievement Award.
